The City Clerk in cities of the first class shall have the custody of all the laws and ordinances of the city and shall keep a regular and correct journal of the proceedings of the City Council. (ACA 14-43-506)
The City Clerk shall, along with the Finance Director, submit to City Council a detailed statement of financial condition of the city. (ACA 14-43-506)
The City Clerk maintains the official seal of the city and may countersign checks on municipal bank accounts. (ACA 14-43-406)
The City Clerk receives files, and retains the financial disclosure statements from elected officials, including the mayor, aldermen, clerk, treasurer, and city attorney. (ACA 21-8-703)
In addition to the duties specifically established by the Arkansas Code or the Constitution, the local governing body may assign certain duties to the city clerk.
Among these will include the following:
- Arrange for the publication of official notices;
- Prepare Agendas for Council Meetings;
- Prepare Council Members Packets along with copies for
- Mayor & other city department heads/supervisors;
- Perform office duties which assist other employees (these duties will normally be set by the Mayor).

The intent of the Arkansas FOIA is to provide access to information in an open and public government, one of the hallmarks of a democratic society. On February 14, 1967, Arkansas adopted one of the strongest and most comprehensive Freedom of Information Acts in the nation. It gives our citizens an opportunity to look at a broad array of information at every level of government and to observe the actions of our government leaders. It also promotes and protects the right of individuals to attend the meetings of policy-making, tax supported bodies.
The FOIA is the people's law, and as the people's lawyer, I feel that it is vital for us to be as well informed about the workings of our government as we can be.
